Terms of Service

The short version: we quote per project, you own your domain and your finished website, you pay advertising platforms directly, and we can't promise specific results — nobody honestly can.

Who these terms cover

These terms apply to this website and to services provided by Momentum Co., a brand of Sauce It Upp Enterprises, based in Linden, New Jersey. A specific project may have its own written proposal — where a proposal and these terms disagree, the proposal wins.

Quotes and pricing

Prices shown on this website are starting prices and are not an offer or a binding quote. Your actual price depends on scope and is confirmed in writing before work starts. Published prices may change at any time; a price already confirmed to you in writing will not change for that project.

Payment

Advertising spend

Advertising budgets are paid by you directly to the platforms (Google, Meta, TikTok and others). We do not mark up your ad spend. Platform policies, approval decisions, pricing and account suspensions are controlled by those platforms and are outside our control.

Your domain and your site

Your domain name is registered in your name and belongs to you. On full payment, you own the finished website design and content we produce for you. We retain ownership of our underlying tools, code libraries, templates and know-how, and we may show the finished work in our portfolio unless you ask us in writing not to.

What we need from you

No guarantee of results

We work hard and we're good at this — but marketing outcomes depend on your market, your pricing, your product, your competitors and platform algorithms we do not control. We do not guarantee any specific ranking, traffic level, number of leads, sales figure, or return on investment. Any figures, examples or past results mentioned anywhere are illustrative and are not a promise of your results.

Third-party services

Our work relies on third-party platforms and hosting. We are not responsible for their outages, policy changes, price increases or account decisions, though we'll help you deal with them.

Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to our services is limited to the amount you paid us for the specific service giving rise to the claim in the three months before it arose. We are not liable for indirect, incidental or consequential losses, including lost profits or lost data.

Ending the relationship

Either of us may end an ongoing service with 30 days' written notice, subject to any minimum term you agreed to. On termination we'll hand over your domain, files and accounts once outstanding invoices are settled.

Governing law

These terms are governed by the laws of the State of New Jersey, and the courts of New Jersey have jurisdiction over any dispute.
